We (the team at GradPilot) are on a mission to help students improve their college application essays through ethical AI-powered analysis and feedback. We hope you love our services as much as we love creating them.

These Terms of Service (“Terms”) describe our commitments to you, and your rights and responsibilities when using our services. Please read them carefully and reach out to us if you have any questions. If you don't agree to these Terms, don't use our services.

1. Who's Who

“You” means any individual or entity using our Services. If you use our Services on behalf of another person or entity, you represent and warrant that you're authorized to accept these Terms on that person's or entity's behalf.

GradPilot is operated by Shri Hacker Enterprise, a sole proprietorship registered in Washington, USA. Throughout these Terms, we refer to GradPilot as “we,” “us,” or “our.”

2. Your Account

When you create an account, you agree to:

  • Provide accurate and complete information
  • Keep your account information current
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use
  • Accept responsibility for all activities under your account

We may suspend or terminate your account if we believe it has been compromised or you have violated these Terms.

3. Minimum Age Requirements

Our Services are not directed to children. You must be at least 18 years old to use our Services. If you're under 18, you may only use our Services with parental consent and under the supervision of a parent or legal guardian who agrees to these Terms.

4. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Engage in Academic Dishonesty: Use our Services to plagiarize, cheat, or violate academic integrity policies. Our Services are designed to help you improve YOUR OWN original work, not to generate essays for you.
  • Submit False Information: Provide false, misleading, or fraudulent information.
  • Violate Laws: Use our Services for any illegal purpose or in violation of any laws.
  • Harm Others: Harass, abuse, threaten, or harm other users or third parties.
  • Compromise Security: Attempt to gain unauthorized access, interfere with, damage, or disrupt our Services.
  • Reverse Engineer: Reverse engineer, decompile, or disassemble our Services.
  • Resell Services: Resell, redistribute, or sublicense our Services without authorization.
  • Duplicate Accounts: Create or maintain duplicate accounts for a single user.
  • Automate Access: Use bots, scrapers, or other automated means to access our Services.
  • Exceed Limits: Exceed any rate limits or usage restrictions we implement.

5. Your Content

Ownership

You retain ownership of the content you submit to our Services (“Your Content”), including your essays and other materials. By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and analyze Your Content for the purpose of providing and improving our Services. We may also create derivative works from your content as part of our service delivery.

Your Responsibilities

You are responsible for Your Content and represent that:

  • You own or have the right to submit Your Content
  • Your Content does not infringe on any third-party rights
  • Your Content is your original work
  • Your Content complies with all applicable laws and these Terms

Our Rights

We may remove or refuse to publish Your Content if we believe it violates these Terms or applicable laws. We do not endorse or guarantee the accuracy, completeness, or usefulness of any content.

6. Our Services

What We Provide

We provide AI-powered essay review and analysis services, including:

  • AI detection analysis
  • Content quality assessment
  • Writing feedback and suggestions
  • Rubric-based evaluation

What We Don't Provide

Our Services do NOT:

  • Guarantee admission to any educational institution
  • Write essays for you
  • Provide professional editing services
  • Offer legal or academic advice
  • Replace human judgment in admissions decisions

Service Availability

We strive to provide reliable Services but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of our Services at any time with or without notice.

7. Fees and Payment

Pricing

Some of our Services require payment. Current pricing is available on our website. All fees are in USD unless otherwise specified.

Payment Terms

  • Credits: Credits are purchased in packages and used to access our Services.
  • Subscriptions: We do not currently offer subscriptions. All purchases are one-time credit packages.
  • Payment Processing: Payments are processed by Stripe. You agree to Stripe's terms of service.
  • Taxes: Prices exclude applicable taxes unless stated otherwise. You're responsible for all applicable taxes.

Refunds

Refunds are not offered. All credit purchases are final.

Cancellation

As we only offer one-time credit purchases, there are no subscriptions to cancel. Credits expire after 1 year and can be used at any time while your account is active.

8. Intellectual Property

Our Services, including our website, applications, designs, logos, and content we create, are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our written permission.

We respect intellectual property rights and expect you to do the same. If you believe your intellectual property rights have been violated, please contact us at support@gradpilot.com.

9. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using our Services, you agree to our Privacy Policy.

10. Disclaimers and Limitations of Liability

Disclaimers

OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRADPILOT AND SHRI HACKER ENTERPRISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Exceptions

Some jurisdictions don't allow the exclusion or limitation of certain warranties or liabilities, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless GradPilot, Shri Hacker Enterprise, and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising from:

  • Your use or misuse of our Services
  • Your Content
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Dispute Resolution

Governing Law

These Terms are governed by the laws of Washington State, USA, without regard to conflict of law principles.

Arbitration Agreement

Any dispute arising from or relating to these Terms or our Services shall be resolved through binding arbitration, except for disputes that qualify for small claims court. The arbitration will be conducted in Washington State in accordance with the rules of the American Arbitration Association.

Class Action Waiver

YOU AND GRADPILOT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page and updating the “Last Updated” date. Your continued use of our Services after changes take effect constitutes acceptance of the new Terms.

14. Termination

You may terminate your account at any time by contacting us at support@gradpilot.com. We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use our Services will cease immediately. Provisions that should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GradPilot regarding our Services.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction.
